Resolving Home Ownership Disputes: a Comparative Review of English and Singapore Developments

In Chan Yuen Lan v See Fong Mun, the Singapore Court of Appeal declined to follow the English developments arising from the Stack/Jones line of cases. Instead, the apex court of Singapore laid down a six-step framework for resolving property ownership disputes that incorporates an interplay between the presumed resulting trust and the common intention constructive trust. This paper examines the points of divergence and convergence between the Singapore approach and the English approach. In particular, it argues that the type of family home disputes that come before Singapore courts accounts and the domestic environment account for a different approach to be taken under Singapore law.
