In this presentation, Ann Kristin will explore the intersection between data protection and intellectual property in EU law. Data protection is a fundamental right in the EU under the General Data Protection Regulation (GDPR) and the EU Charter of Fundamental Rights. However, the lack of specificity in the GDPR creates uncertainty regarding the scope of the right in the context of commodification of personal data by Internet technology companies. The possible tension between the rights of individuals in the GDPR and intellectual property rights of commercial data controllers will be considered.
