The development of the right of communication to the public under EU copyright law has left much to be desired. The consequences of this include incoherence in the case law of the CJEU, and more generally uncertainty as to the scope of the right. This paper will explore the history and the issues surrounding the right of communication to the public, and suggest some possible solutions.
