In this seminar, Filipe Bastos (Lisbon) is going to discuss his current research on "A Demoi-cratic public law? The constitutional reasons for procedural righths of Member States as subjects of Union Administration".
This inquiry concerns the nature and justification of the procedural protection afforded by the CJEU to Member States and thier public authorities. More specifically, it examines whether such protection could be explained from the point of view of the theory of European demoi-cracy, a theory with both descriptive and normative dimensions that considers Europe's political and constitutional architecture to result from its commitment to ground its legitimacy on the plurality of its constitutent peoples, understood both as citizens and states.
