Environmental Torts: a Parallel between English and Brazilian Legal Systems

The emergence of an environmental statute, both in common law and in civil law systems, held the idea of prevention as its main objective. Nevertheless, scholars remark that tort law still performs an important role by including compensatory justice when regulation fails. Also, once the effects of these accidents spread  across national borders, the necessity of finding an intersection between several legal systems arises in order to maintain stability and security. In such a context, this seminar proposes tracking a parallel between different kinds of environmental regulation, as Brazilian and English laws do, in matters such as, amongst others, causation, strict liability and recovery, to understand better the implications, advantages and limitations of tort law in providing efficient tools for environmental protection.

A sandwich lunch will be available outside the Law Board Room from 12.30. The meeting will begin at 1pm.
