Already Gaius taught that “naturalis enim simul et civilis ratio suasit alienam condicionem […] ignorantis et inviti […] deteriorem [nos facere] non posse” – We cannot worsen the position of somebody else against his will and without his knowledge. However, contracts are inherently detrimental for all who are not party to them. The presentation will explain the importance of understanding the detrimental effects of contracts on third parties and analyse whether the law offers a coherent and consistent fromework for protecting such third parties.
