On 28 November 2016 the UK Government confirmed that it is proceeding with preparations to ratify of the Unified Patent Court (UPC) Agreement. This seminar will explain the key features of the UPC and will address three questions that will arise in relation to the participation of the UK in the UPC post-Brexit: (1) What arrangements could be put in place so that the UK could participate in the UPC post-Brexit? (2) How might the Regulation on the European Patent with Unitary Effect apply post-Brexit? (3) What would happen should the UK decide to leave the UPC after ratification?
