Article 22 of the General Data Protection Regulation (GDPR) of 27th April 2016 created a right not to be subject to automated decision-making—that is, decisions made with the help of computers. This talk discusses the ways in which this right has been transcribed in UK and French Law. Focusing on a comparative definition of automated decision-making, I will explain how and why the legal regime of this right is different in the three legal systems.
