Dissertation by former MJur student published in Journal of Private International Law
The Journal of Private International Law recently published the dissertation of one of our MJur graduates, Leon Theimer, who is now pursuing a DPhil at Humboldt University, Berlin.
‘Protection against the breach of choice of court agreements: A comparative analysis of remedies in English and German Courts’ was published in Volume 19, 2023 - Issue 2 and online on 13 November.
The paper undertakes a functional comparison of the remedies for breach of exclusive choice of court agreements in English and German courts, painting a picture of different approaches to a common problem. It identifies how both English and German courts perform similar functions in different ways.
The paper also serves as a source of information for parties regarding the potential benefits and drawbacks of choosing English and German courts in their choice of court agreements and the consequences of breaching them.
