Suing the climate b#***~@s. On carbon and the conflict of laws

‘Climate litigation’ or the wider concept of ‘just transition litigation’ is cautiously claiming successes. Yet it faces formidable obstacles. Some of these are related to private international law/conflict of laws in the strict sense, including issues of jurisdiction and forum shopping, applicable law and the difficulties of enforcement. Others concern wider issues of civil procedure, such as foreign sovereign immunity, the act of state doctrine, standing and litigation funding, as well as the interference of investor-State dispute settlement.
In this talk Geert will attempt to at least introduce these issues, which hopefully speak to not just those in the know on conflict of laws, but to a wider audience interested in climate law.

A light lunch will be provided from 12.30pm before moving to a presentation and discussion on the above topic at from 1-2pm. Lunch will be held in the Private Dining Room next to the JCR Lecture Theatre at St Catherine's College. The talk and discussion will be held in the JCR Lecture Theatre.
