Abstract

This seminar will explore the extent to which the law permits children to make decisions about their own medical treatment. It will explore both the implications where a child consents to  and where she refuses, treatment, examining how the law approaches the concept of ‘capacity’ in relation to children. It will also consider the wider issue raised by the courts making medical treatment decisions that involve questions of value, namely which values (or whose) should determine what is ‘best’ for the child.
