Learning the Lessons of Lorentzen v Lydden [1942] 2 KB 202
Public policy allows the English court to avoid the conclusion to which its conflicts rules are leading it by deleting a rule of foreign law which it would be intolerable to have to apply. The question to be addressed is whether public policy may also allow the court to avoid the conclusion to which its conflicts rules are leading it by doing something else (and if so, what else, and when) to avoid a result which would be intolerable. Anyone who wishes to inform themselves of Professor Briggs' point of departure should re-read Lorentzen v Lydden [1942] 2 KB 202.
