This presentation offers a critical examination of the arguments for individualistic data governance as well as those that argue for collective governance, against their historical background. Building on works from economic theory and the analysis of data protection as a public good, it will be explored how the negative effects of individualistic data protection governance can be avoided, whilst retaining rights where they can be meaningful, with particular emphasis on the role of consent as opposed to other rights.

 

Emmanouil Bougiakiotis is a PhD researcher in law at the European University Institute in Florence working on collective approaches to data protection governance. His research focuses on law, economics, and policy. Before returning to academia for his doctoral research he studied at the Democritus University of Thrace and Oxford, and he worked in the public sector including two brief stints at the Greek data protection authority and the European Data Protection Board.
