Non-Implemented Covid Vaccine NFCS
Four countries, Brazil, Honduras, Lebanon and Tunisia, have enacted legislation to create a national NFCS for COVID-19 vaccines, but have not actually implemented a national NFCS in practice.
Brazil
Law 14.125/2021 set out a framework for a national NFCS for investigating compensation claims related to COVID-19 vaccination, but this was never implemented and has been repealed on 15 June 2022 by Provisional Measures (Government Law) 1.126/2022.
Honduras
Honduras is a member of the COVAX NFCS.
Decree 193-2020, the Special Law for the Guarantee of Care for Serious Adverse Events Attributed to the Application or Use of the Vaccine Against COVID-19 and if Applicable for Compensation Without Fault, sets our provisions for no-fault compensation. Article 6 of the Decree states that the Care Unit for Persons Vaccinated against COVID-19 is created under the subordination of the Director-General for Surveillance of the Regulatory Framework. Article 19 of the Decree states that the Secretary of State in the Health Office must issue the respective Regulations to this law within 120 days. We cannot find any evidence of the Care Unit for Persons Vaccinated against COVID-19 nor any Regulations.
Lebanon
Law No. 211/2021 on Regulating the Emerging Use of Medical Products to Combat the COVID-19 Pandemic sets out a framework for a national NFCS for investigating compensation claims related to COVID-19 vaccination. This law sets out that a specialised Compensation Committee should have been set up by the Lebanese Ministry of Public Health to establish NFCS application procedure and to determine cases. We cannot find any evidence that this Compensation Committee has been established.
Tunisia
Tunisia is a member of the AVAT NFCS and the COVAX NFCS.
Law 2021-10 sets out a framework for a national NFCS for investigating compensation claims related to COVID-19 vaccination. This law sets out that a decree detailing the process for claims should be issued within three months. We cannot find any evidence that this decree has been issued.
